MICHAEL A. MORSE is a partner at Pietragallo Gordon Alfano Bosick & Raspanti, LLP where he assists clients in the following practice areas: Healthcare, Commercial Litigation, Government Compliance and Enforcement, Internal Investigations, False Claims Act/Qui Tam Lawsuits, White Collar Criminal Defense, Title IX, and Employment Law. With over two decades of experience, Mr. Morse counsels and represents entities and individuals in several industries including: healthcare, life sciences, and higher education.

Mr. Morse is a former prosecutor who has appeared in hundreds of criminal and civil cases in federal and state courts across the country. He has been selected as a Pennsylvania Super Lawyer from 2013 through 2024 in the area of White Collar Criminal Defense. Mr. Morse has also been selected by The Legal Intelligencer as a Lawyer on the Fast Track for 2010.

Healthcare
Mr. Morse represents hospitals, health systems, medical schools, medical device manufacturers, pharmacy benefits managers, managed care organizations, physicians, health care practices, and executives of pharmaceutical manufacturers in matters related to:

  • Compliance with Medicare and Medicaid regulations
  • Compliance with federal and state fraud and abuse laws, including the federal Anti-Kickback Statute and Stark Law
  • The defense of False Claims Act investigations and lawsuits
  • Drafting and assessing compliance plans and policies
  • Negotiating and drafting provider and vendor agreements
  • Employment litigation, including non-competes and restrictive covenants
  • Responding to subpoenas from federal and state regulatory agencies and Congressional Committees
  • Compliance with Food and Drug Administration regulations
  • HIPAA privacy breach assessment and mitigation
  • Conducting due diligence of private equity investment

Representative Matters:

  • Successfully defended a publicly traded pharmacy benefits manager and one of the largest health insurers against alleged violations of the federal False Claims Act
  • Drafted comprehensive compliance plans and policies for three separate spinal implant manufacturers and a national dialysis provider
  • Drafted and negotiated hundreds of provider and vendor agreements for a large behavioral health managed care organization
  • Conducted numerous internal investigations for a major medical school and academic medical center related to allegations of research misconduct and fraud, waste, and abuse
  • Advised physicians and hospitals on employment contracts, non-competes, and restrictive covenants
  • Represented physicians and other healthcare professionals before state licensing boards
  • Advised physicians and medical practices on private equity investment and acquisitions

Mr. Morse is certified in Healthcare Compliance by the Health Care Compliance Association and the Compliance Certification Board (CCB). He serves as a member of the editorial board of Compliance Today, the monthly journal of the Health Care Compliance Association.

Higher Education
Mr. Morse regularly represents colleges and universities in a wide-variety on litigation, investigations, and compliance matters, including:

  • Investigating Title IX complaints
  • Investigating alleged violations of codes of conduct and intellectual property policies
  • Investigating and litigating disciplinary actions (including for tenured faculty and students)
  • Investigating and litigating claims of employment discrimination and retaliation
  • Investigating and litigating allegations of research misconduct, NIH grant fraud, violations of the federal False Claims Act and the HRSA student loan program requirements
  • Advising on H1-B visa matters for visiting faculty and employees
  • Advising on the recruitment, employment, and termination of faculty
  • Conducting internal investigations concerning alleged misconduct in Athletic Departments
  • Conducting a comprehensive internal investigation following a fatal Active Shooter event

Mr. Morse is a member of the National Association of College and University Attorneys. He regularly presents to university leadership on compliance, investigations, and litigation matters.

White Collar Criminal Defense / Government Investigations
Mr. Morse regularly represents entities and individuals in a wide-variety of white collar criminal defense and government investigations matters across the country, including:

  • Securing an acquittal from a federal jury on behalf of a prominent dermatologist charged with eighty-two counts of healthcare fraud
  • Successfully defending a medical device company in an investigation of the alleged bribery of federal government officials
  • Securing a declination of criminal charges against a government contractor accused of allegedly bribing state government officials
  • Securing the dismissal of criminal charges against a dentist accused with multiple counts of federal healthcare fraud
  • Securing the declination of criminal charges against a physician accused of controlled substance violations related to his prescription practices
  • Securing the dismissal of criminal and civil charges against a major wholesaler accused of federal anti-trust violations
  • Regularly responding to federal and state grand jury subpoenas, HHS-OIG subpoenas, and Civil Investigative Demands
  • Conducting investigations related to alleged violations of the Forreign Corrupt Practices Act (FCPA)

Mr. Morse is a member of the National Association of Criminal Defense Lawyers. He served as a member of the editorial board of the American Bar Association’s Criminal Litigation newsletter, and a member of the Steering Committee of the American Bar Association’s Mid-Atlantic White Collar Crime Committee.

Mr. Morse is the former Chair of the firm’s national False Claims Act / Qui Tam practice group. He regularly represents clients in federal and state False Claims Act litigation, including cases involving healthcare, defense contracting, and government procurement fraud. Mr. Morse has served as counsel for the lead whistleblower in numerous false claims cases, including:
