David E. Lamm
DAVID E. LAMM is a Partner at Pietragallo Gordon Alfano Bosick & Raspanti, LLP. He is a member of the firm’s Toxic Tort and Medical Malpractice Practice Groups.
Mr. Lamm has represented manufacturers, suppliers, and contractors in toxic litigation, product liability matters, and insurance issues. He has experience in counseling business executives, handling complex cases, ensuring legal and regulatory compliance, and implementing risk management and loss avoidance strategies and programs. He has handled coordination of national and regional defense teams for Fortune 500 corporations and other major defendants as well as led discovery planning and implementation. He has been involved in depositions, motions, and hearings in multiple jurisdictions in the United States.
Previously, Mr. Lamm personally has tried general personal injury cases for the defense before juries in both Pennsylvania and West Virginia.
Mr. Lamm has saved millions of dollars in the representation of a client group in approximately 950 claims with no settlement monies paid in the West Virginia jurisdiction. He defended the same group in an Ohio based suit presenting a scientifically-based summary judgment argument resulting in the dismissal of all claims with no new claims filed.
Mr. Lamm has served as co-trial counsel in a manganese related case in Pennsylvania involving complex scientific and medical issues. He was able to establish for the jury that the plaintiff suffered from idiopathic Parkinson’s disease rather than a neurological disease alleged to have been caused by the client’s product.
Mr. Lamm also has represented a client group in manganese litigation, presenting scientific and medical issues to a West Virginia defense group to educate tangential allied stakeholders and effectively manage litigation in the best interests of the clients, resulting in the removal of the primary case.
He removed multiple thousands of case matters from West Virginia to a Federal MDL after having discovered plaintiffs from Texas, with prior claims, in which there was testimony of employment in shipyards under Navy contracts thus supporting an argument for Federal Officer Removal. He demonstrated that less than 100 plaintiffs out of the thousands had any connection to West Virginia.
Mr. Lamm has defended a national manufacturer of excavating equipment in a product liability case, obtaining dismissal of a diversity-destroying defendant, forcing removal, and paving the way for a nuisance settlement.
