Albert N. Peterlin

ALBERT N. PETERLIN is an attorney in the Commercial Litigation Practice Group and the Construction Practice Consortium of Pietragallo Gordon Alfano Bosick & Raspanti, LLP.

Mr. Peterlin concentrates his practice in the areas of business torts, construction, corporate, general commercial, international trade, and securities litigation.  He also has experience in the areas of public investors’ litigation and arbitration, racketeer influenced corrupt organizations (RICO), intellectual property, bankruptcy, and surety defense litigation.

Matters representative of Mr. Peterlin’s practice include:

  • Prosecution of a securities fraud case before the U.S. District Court for the Middle District of Pennsylvania on behalf of the individual purchasers of an established limousine company.  The claim was based on income generated outside of the scope of the Pennsylvania Public Utility Commission Certificate of Public Convenience authority to operate as a common carrier and limousine company.

  • Defense of a securities fraud case before the U.S. District Court for the Central District of California (Western Division) on behalf of a promoter of an unregistered international private offering of leasehold interests in certain Texas oil and gas wells.  The case was instituted by private investors against the issuers, who filed a third-party complaint for indemnification and contribution against the promoters.

  • Defense of construction litigation cases before various courts on behalf of surety companies relating to payment and performance bond obligations.

  • Prosecution of multiple financial services malpractice and securities fraud cases before the National Association of Securities Dealers on behalf of public investors.  The claims included unsuitability, churning, and unauthorized trades.

  • Defense of a subpoena enforcement action before the U.S. District Court for the Eastern District of Pennsylvania on behalf of a financial institution.  The case was instituted by the U.S. Department of Labor to attempt to compel compliance with a subpoena it issued upon the financial institution.  The defense was based on the Gramm-Leach-Bliley Act.

  • Prosecution of a construction litigation case before the U.S. Court of Claims on behalf of a contractor for delay damages arising from the late issuance of a notice to proceed by the owner.

  • Defense of a § 337 investigation before the U.S. International Trade Commission on behalf of a domestic battery manufacturer.  The investigation was instituted by a well-known battery manufacturer against various foreign and domestic competitors for patent infringement. 

  • Prosecuted a complex breach of contract and warranty case before the American Arbitration Association on behalf of a large steel processor.  The case was instituted against a manufacturer of resistance welders based on the failure of the mash seam welder to function according to specification on the steel processor’s new galvanizing line.

  • Prosecuted a mechanics’ lien case before a Court of Common Pleas on behalf of a contractor against the owner.

  • Defense of a breach of contract case before the U.S. District Court for the Western District of Pennsylvania on behalf of a large steel processor.  The case was instituted by a large international steel trader based on the steel processor’s rejection of steel substrate coils for being under-width contra ASTM A-568.

  • Defense of a securities fraud case before the U.S. District Court for the Middle District of Pennsylvania (Harrisburg Division) on behalf of an issuer of an unregistered private offering of leasehold interests in certain Ohio and West Virginia oil and gas wells.  The case was instituted by a single investor.

  • Defense of a construction litigation case before a Court of Common Pleas and subsequently the American Arbitration Association on behalf of a contractor.  The case was instituted by the owner based on breach of contract and fraud. 

  • Prosecution of a complex breach of contract and piercing the corporate veil case before the U.S. District Court for the Western District of Pennsylvania on behalf of holders of a promissory note.  The case was instituted against the partners of a low-income housing tax credit (LIHTC) syndicated project (26 U.S.C. § 42). 

Mr. Peterlin serves as an arbitrator for the Financial Industry Regulatory Authority, the National Futures Association and the New York Board of Trade. He is also a member of the International Bar Association, the Customs and International Trade Bar Association, and the board of directors of the Slovenian Genealogy Society.

He received his J.D. degree from the Widener University School of Law and his LL.M. in Trial Advocacy from Temple University Beasley School of Law.  Mr. Peterlin received his B.S. from the University of Scranton.

Mr. Peterlin is licensed in Pennsylvania and Maryland and is also admitted to practice before the U.S. District Courts for the Western, Middle and Eastern Districts of Pennsylvania and the District Court for Maryland, the U.S. Court of Appeals for the Third Circuit, the U.S. Tax Court, the U.S. Court of International Trade and the U.S. Supreme Court.  He also has been admitted pro hac vice to the federal courts of California, Delaware, Michigan, New York and Oklahoma.  In addition, Mr. Peterlin has represented clients before the U.S. International Trade Commission, the National Association of Securities Dealers and the American Arbitration Association.
